1. Introduction
  • Ownership: TourFlow System is part of Khmer Linguistics and Digitalization with the registered number 5000217593, located in Sala Konseng Village, Sangkat Svay Dang Kum Siem Reap, Cambodia.
  • Purpose of the Agreement: By using our services, you agree to these Terms and Conditions and any other policies that may be posted on our website from time to time. These Terms and Conditions govern your use of the TourFlow app. We may update these Terms periodically, and you should review them regularly. Your continued use of the services constitutes your acceptance of any changes.
  • Definition: "We," "us," and "our" refer to TourFlow, the company that owns and operates the TourFlow app and platform. We are responsible for providing the services and features outlined in these terms and conditions.
  • "User" refers to any individual or entity that accesses, uses, or subscribes to the services provided by TourFlow through the app or platform.
  • "Service" refers to the platforms and features offered by TourFlow, including the TourFlow app and any related systems, tools, or functionalities that facilitate travel management for users.
  • Effective Date: Terms and Conditions will be applicable from the day that you are using our service until the day you terminate your usage of our service.
2. User Responsibilities
  • Eligibility: You must be at least 18 years old to use our Service. By accessing or using our Service, you represent and warrant that you meet this age requirement. You should be legally capable of entering any binding agreements.
  • Account Creation: To access certain features of the app, you may be required to create an account. You agree that all information provided during the registration process is accurate, complete, and current. You also agree to maintain confidentiality of your account credentials and are solely responsible for any activities that occur under your account.
  • Acceptable Use: Through the terms and conditions, you agree not to use the service for any unlawful purposes or violations of any applicable laws, engage in any activity that could damage, disable, or interfere with the services or its functionality, attempt to gain unauthorized access to any parts of the service or any other accounts, systems, or network connected to the service or share false or misleading information.
3. Our Platform
  • What we offer: TourFlow exclusively offers the following services: CRM and task management to facilitate client and vendor collaboration with reminders and automated functions; tools for planning clients' trips, including organizing tour activities, accommodations, meals, guides, transport, and other services; automated pricing to ensure accuracy with flexible tax configurations and markup management; vendor management features to consolidate essential vendor data and streamline approvals; a quoting and booking system for managing itineraries of varying lengths; and an invoicing module for issuing single or multi-tour invoices directly from the client dashboard.
  • What we do not offer: TourFlow is not responsible for providing any features or services beyond those explicitly listed.
4. User Content and Intellectual Property
  • User-Generated Content: By uploading the content, users grant the app a license to use, modify, or distribute the content either for promotional or operational purposes. We have the right to remove or edit any contents that are seen as obscene or inappropriate. Consequences of violations can be content removal, temporary or permanent user bans, legal actions for severe violations.
  • Platform Intellectual Property: All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, and software, are the property of TourFlow or its licensors and are protected by intellectual property laws.Users are not allowed to reproduce, distribute, or copy the platform’s copyrighted materials without any explicit permissions.
5. Payment and Pricing
  • Pricing information: Our app offers flexible pricing based on your chosen services. Each plan or service clearly displays its cost, with no hidden fees. Additional features or add-ons may incur extra charges, which will be transparently listed during checkout.
  • Payment Methods: We provides flexible and secure payment options to ensure a seamless experience for our users. Payments can be made securely through our Merchant of Record, Lemon Squeezy, based in the United States. They offer multiple payment options such as credit/debit cards, digital wallets (e.g. Paypal), and bank transfers. Multiple currencies are supported based on the user’s locations. All payment information is encrypted and stored securely. Multi-factor authentication may be required for sensitive transactions
  • Refund Policy: All payments made to TourFlow for subscriptions, services, or features are non-refundable. Once a payment has been processed, users will not be entitled to any refund, whether for partial use of services, unused periods, or cancellation during the billing cycle. Users are encouraged to carefully review their selected plans, pricing, and terms before completing a purchase. TourFlow is not obligated to provide refunds for any reason, including dissatisfaction, failure to utilize the service, or misunderstanding of the app’s functionality. This policy ensures clarity and supports our commitment to maintaining operational continuity and service quality.
6. Privacy and Data Protection
  • Data Collection: Our App typically collects various types of data to enhance users experience, enable booking, and ensure smooth operations. Commonly collected data includes personal information, account information, payment information, location data, booking preferences and history, devices and app usage data, feedback and reviews, and consent and legal data.
  • Data Storage: TourFlow stores user data with third-party providers, namely Hostinger and DigitalOcean, to ensure reliable and secure hosting of our platform and services. Both Hostinger and DigitalOcean comply with major data protection regulations, including the General Data Protection Regulation (GDPR) in the European Union, ensuring that user data is handled with the utmost care and in full compliance with privacy laws. For subscription payments, they are processed through Lemon Squeezy. 7. Liabilities and Disclaimers
  • Limitations of Liability: We will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including any errors or omissions in the content or any loss or damage to data or profits. You are responsible for your use of the app, including ensuring that your device meets the app’s technical requirements and that your actions comply with applicable laws.
  • Force Majeure: We are not liable for any failure or delay in performing our obligations under these terms due to events beyond our reasonable control, including but not limited to acts of God (e.g., natural disasters such as earthquakes, floods, hurricanes), acts of government (e.g., regulations, laws, or orders), civil disturbances, Internet or telecommunication failures, power outages, or cyberattacks, and pandemics, epidemics, or public health emergencies. If such an event occurs, our obligations under these terms will be suspended for the duration of the event. We will make reasonable efforts to resume service as soon as the event concludes.
8. Dispute Resolution
  • Governing Law: These Terms will be governed by and construed in accordance with the laws of Cambodia. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in Phnom Penh, Cambodia.
  • Arbitration or Mediation: If informal resolution fails, the parties agree to enter mediation with an impartial third party. The mediator will help both parties come to a mutually acceptable solution, but the mediation is non-binding unless agreed otherwise. If mediation does not resolve the issue, the dispute will be resolved by binding arbitration.
  • Class Action Waiver: You agree that any disputes, claims, or causes of action arising out of or relating to these Terms or your use of the app shall be resolved on an individual basis, and you agree not to participate in any class action, class arbitration, or other collective legal action against TourFlow.
9. Terms and Termination
  • Termination Rights: Common conditions under which an account may be suspended or terminated, categorized for both the platform and the user include the termination or suspension by the platform and termination by the user. Terminations of accounts by the platform may result from violations of Terms of Services, non-payment or billing issues, security concerns regarding data breaches or suspicious activity, breach of License or Intellectual Property Rules, and accounts inactivity. Termination by the user might be through personal choice or dissatisfaction, change to Terms or Privacy Policy, and privacy concerns.
  • Consequences of Termination: If the account is terminated by the user, any scheduled bookings may be canceled according to the platform’s cancellation policies, and users may incur penalties if the cancellation falls outside the allowed cancellation window. If the account is terminated by the platform, the platform may cancel all future bookings, with refunds or penalties based on the circumstances. Refund eligibility depends on whether the termination was due to a user’s violation or other resources.
10. Modifications to Terms
  • Right to Change Terms: We reserve the right to update or modify these Terms of Service at any time at our sole discretion. If we make material changes to these terms, we will notify you by email or in-app notifications prior to the changes taking effect. Your continued use of the platform after the updated terms become effective constitutes your acceptance of the changes.   • Notification of Changes: You will be informed about any changes on our platform through either In-App Notifications, E-mail, Website announcements, Push Notifications, or through our media and Blog Posts.

  • External Links: Our Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites.
  • Affiliate or Partner Services: We may offer services, products, or promotions provided by third-party affiliates or partners. These services are governed by the terms and conditions of the respective third parties. While we strive to collaborate with reputable partners, we are not responsible for the performance, quality, or outcomes of Partner Services unless explicitly stated. If you choose to engage with Partner Services, you agree to comply with their terms and resolve any disputes directly with the partner.
12. Miscellaneous Provisions
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms does not waive our right to do so in the future.
  • Entire Agreement: These Terms of Service, along with our Privacy Policy and any other policies or legal notices expressly incorporated by reference, constitute the entire agreement between you and TourFlow regarding your use of our services. No additional terms or conditions communicated by you will be binding unless explicitly agreed to in writing by an authorized representative of TourFlow.
